Draft — not yet reviewed, and not in force. This page describes how ViyafaariOS actually works today, so it is accurate, but it has not been checked by a lawyer and it is not a contract. Sections marked awaiting content below are deliberately unwritten rather than guessed at.

These are the terms on which ViyafaariOS is sold and used.
Everything below is already stated openly on this site — on the pricing section and in the FAQ. Nothing here is a new commitment invented for a legal page. Where a clause is still missing, this page says so rather than filling the gap with something nobody agreed to.
What you are buying
ViyafaariOS is a point-of-sale and accounting system for cafés, restaurants and small food businesses in the Maldives. It runs as a hosted service: we provision an installation for your business, on its own database, and you use it through a browser.
There is one package. Every feature is included. Nothing is held back for a higher tier.
What it costs
Price is per business, per month, in Maldivian Rufiyaa, at the rates published on the pricing section of this site. The rate depends on how many businesses are on the account and applies to all of them.
Outlets are unlimited and are never billed. A business may run as many outlets as it likes at no extra cost. Only the number of businesses changes the price.
Paying annually takes a percentage off the monthly price, as published.

How you pay
We invoice you, and you pay by bank transfer. You are invoiced before each period, and the system tells you when a renewal date is approaching.
There is no card on file, no payment gateway and no automatic charge. Nothing is ever taken from you without an invoice you have seen first.
Awaiting content. State how many days from invoice to due date, and what happens on a late payment beyond going read-only — whether any interest or charge applies. Say nothing here rather than guess.
If you stop paying
Your installation goes read-only. You keep reading, printing and exporting everything — reports, statements, the GST return, receipts, customer statements, exports — because those are records you are legally required to keep. What stops is recording anything new, until it is renewed.
You are warned on every screen for two weeks before this happens.
We do not delete your data because an invoice is late.
Your data is yours
Every business runs on its own database, separate from every other customer's.
Ask at any time — including when you are leaving — and you get a complete export of your data in a standard format, at no charge.
Nothing of yours is ever deleted automatically. Deletion happens only as a deliberate act, after an export has been handed to you and acknowledged.
Awaiting content. State the grace period between an account closing and the installation being shut down and removed. The FAQ asks the same question and needs the same number.
Setting it up
We set the system up with you: we load your catalogue, put in your opening balances, train your staff on a quiet shift, and stay on call for your first service and your first month-end.
Awaiting content. State whether setup and migration are included in the price or charged separately, and what support you commit to — the hours, the channel, and how quickly you answer. Do not promise 24/7.
Clauses this page does not yet have
These need a lawyer, not a developer, and they are deliberately absent rather than approximated. They must be written before this page can be treated as a contract:

- Term and notice. How long a subscription runs and how either side ends it, including notice required.
- Uptime and service levels. What availability, if any, is promised, and what happens if it is not met. If nothing is promised, say that plainly.
- Warranties and their limits. What the software is warranted to do.
- Limitation of liability. What ViyafaariOS is and is not liable for, and any cap.
- Acceptable use. What a customer may not do with the system.
- Confidentiality obligations on both sides.
- Governing law and disputes. Which law applies and where disputes are settled.
Nothing in this draft limits anyone's liability, because writing such a clause without advice would be worse than having none.
Changing these terms
If we change these terms, we will change this page and move the date at the top, and we will tell you rather than leave you to notice.
A price change never applies to a period you have already been invoiced for.
